By accessing or using our website, services, or any other product offered by Doctoury, you agree to be bound by these Terms and Conditions. This Agreement applies to both patients seeking second medical opinions and healthcare consultations, as well as hospital partners utilizing our platform to support their services.

Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

"Service Provider" refers to Doctoury and any affiliates, agents, contractors, or third-party service providers acting on our behalf.

"Hospital Partner" refers to healthcare institutions, clinics, hospitals, and other medical organizations partnering with Doctoury to offer services, including second opinions and support services.

"Second Opinion" refers to a consultation service where patients can receive an additional review and advice on their diagnosis or treatment plan from another medical professional.

"Patient" refers to any individual who utilizes Doctoury’s services, including seeking second opinions, medical consultations, or other healthcare-related services.

"Refund" refers to the reimbursement of fees or costs paid for services that were not rendered or where the patient or hospital is entitled to a refund under the conditions specified in these Terms and Conditions.

"Service(s)" refers to the healthcare and telemedicine services provided by Doctoury, including second medical opinions, patient coordination, and logistical support for hospital clients.
Scope of Services
Doctoury offers the following services:

Support Services to Hospitals: We provide a platform for hospital partners to enhance their operational efficiency, offering patient coordination, logistical support, and assistance with international patient care.

Second Medical Opinion Consultation: We offer patients access to professional second medical opinions regarding their diagnosis or treatment plan. This service includes reviewing medical records, consultations with medical specialists, and providing an alternative perspective on the patient’s care.

Consultation and Telemedicine Services: We provide virtual consultations between patients and healthcare professionals, enabling remote diagnosis, treatment advice, and follow-up care.

Other Support Services: We may offer additional services as described on our website, such as visa assistance, travel coordination, accommodation management, and post-treatment follow-up services.
Hospital Responsibilities and Obligations
As a hospital partner, you agree to the following:

Provide Accurate and Complete Information: Ensure all patient records and data shared with Doctoury are accurate, complete, and up-to-date.

Cooperate with Service Providers: Work with Doctoury and third-party providers to deliver services effectively, including handling patient inquiries, second opinions, and medical consultations.

Adhere to Legal and Regulatory Standards: Comply with all applicable laws, including patient privacy laws such as HIPAA (Health Insurance Portability and Accountability Act) or GDPR (General Data Protection Regulation), as required.

Ensure Patient Safety and Quality of Care: Hospital partners must ensure that patients receive high-quality medical care, and cooperate with Doctoury to resolve any complaints related to service delivery.
Patient Responsibilities and Code of Conduct
As a patient using our services, you agree to:

Provide Accurate Medical Information: Ensure that all medical history, diagnoses, treatments, and other relevant information shared with Doctoury and its Service Providers is accurate and complete.

Adhere to Appointment Schedules: Attend all scheduled consultations, or notify Doctoury in advance if you are unable to attend.

Use Services in Good Faith: Use Doctoury’s services solely for personal health purposes and not for fraudulent or malicious activities.

Data Sharing for Second Opinions: Consent to the sharing of relevant medical data with healthcare providers for second opinions and consultations.

Follow Medical Advice: Acknowledge that second opinions or telemedicine consultations do not replace in-person consultations with primary healthcare providers.
Data Privacy and Confidentiality
Doctoury is committed to safeguarding the privacy and confidentiality of patient information. We comply with all applicable privacy laws, including HIPAA and GDPR, where applicable.

Patient Data: Any personal health information (PHI) shared with Doctoury or its partners will be kept confidential and used only for the purpose of providing the requested services.

Data Sharing: By using our services, you consent to the sharing of necessary medical data between our partners, including healthcare professionals, for the provision of second opinions and other services.
Refund Policy
Our refund policy is transparent, fair, and customized based on individual cases. Refund eligibility applies as follows:
Patient Refund Eligibility

Dissatisfaction with Service: If the patient is dissatisfied with the service (e.g., second opinion consultation) due to failure to meet the agreed terms, a refund may be considered.

Duplicate Charges: Refunds will be issued in case of duplicate charges or incorrect billing.

Service Not Rendered: If a booked service is not provided or canceled by Doctoury, a full refund will be issued.
Hospital Refund Eligibility

Service Not Rendered: If Doctoury fails to provide the agreed service to a hospital (e.g., logistical support or patient coordination services), a refund will be considered.

System Outages: Refunds for system downtime or service interruptions will be evaluated based on the length and impact of the issue.
Refund Calculation
Refunds will be evaluated on a case-by-case basis, considering factors such as service usage, patient satisfaction, and internal review outcomes.
Refund Request Process

Request Submission: Refund requests must be submitted via the Doctoury platform or through our customer service within 30 days of the service date.

Review Process: All requests will be reviewed within 15 business days.

Resolution: Refunds, if applicable, will be processed and issued within 30 days of approval.
Limitation of Liability
Doctoury shall not be held liable for any outcomes resulting from the second opinion consultations or any medical advice provided through our services. While we aim to ensure high-quality services, the final responsibility for medical decisions lies with the patient and their primary healthcare provider.

Indirect or Consequential Damages: Doctoury is not liable for any indirect, incidental, or consequential damages arising from the use of our services.
Dispute Resolution
In the event of a dispute arising from these Terms and Conditions, both parties agree to first attempt resolution through informal negotiations. If unresolved, disputes will be handled via mediation or, if necessary, arbitration in accordance with Ukranine Law, before a neutral third party.
Modification of Terms
Doctoury reserves the right to modify these Terms and Conditions at any time. All changes will be communicated through our website or via email to registered users. Modifications will be effective immediately upon posting unless otherwise stated.
